Springfield DUI Attorney

Aggressive Legal Representation
For Your DUI Case

Our Springfield/Western Massachusetts DUI Defense Attorneys serve the Springfield, MA Metropolitan Area which includes Hampden, Hampshire, Berkshire, and Franklin Counties in Massachusetts.

The crime of drunk driving is known as OUI, otherwise known as "Operating Under the Influence."  Other common names are DUI ("Driving Under the Influence") and even DWI.  No matter what you call it, it is a serious offense that requires an experienced OUI Defense Attorney to get you past the charges and back on your feet.

Did you know Massachusetts has an implied consent law, which allows for them to automatically take a breathalyzer test on you following an arrest?  Refusing to take one is automatically a penalty.  The legal limit considered to be driving under the influence of alcohol for your Blood Alcohol Content (BAC) must be above .08% if over 21 or .02 for drivers who are Under 21 to be found guilty.  The District Attorney's Office is required to prove in court, beyond a reasonable doubt, the following three things:

  • That you were driving the vehicle;
  • It was being driven on a public roadway and;
  • You were driving under the influence of alcohol or drugs.

Having successfully represented hundreds of DUI clients, our experienced and aggressive Springfield DUI Defense Attorneys know how to effectively use numerous defenses to protect you against these charges.  Merely because you were arrested for DUI does not automatically mean you will be convicted.  Our legal firm can help you with what to do first.

Springfield DUI Lawyer

One of the most important points in defending your case is whether the police officer had probable cause to pull you over in the first place.  Determining this is one instance where your attorney may be able to challenge this point and use it in your defense.  However, if you are pulled over and given a Field Sobriety Tests, also known as a breathalyzer test, and your BAC is above the legal limit, you will be arrested.  Massachusetts has upheld the constitutionality of roadblocks, also known as sobriety checkpoints, so you may be stopped at one of these randomly for a test.  There is strict protocol that must be followed by law enforcement at these checkpoints. Regulations not being followed during the checkpoint opens the door to another possible defense for you.  Because prosecutors in Springfield are very aggressive, you need a very hard line defense to ensure you are given every opportunity to beat your charges.

Our uncompromising legal team can represent you throughout the DUI process.  There are many factors that come into play, which The Western Massachusetts DUI Defense Group is well versed in.  Whether you need assistance with Defending DUI, Registry Hearings, Unlawful Police Stops, Hardship License, Repeat Offenders, Sobriety Checkpoints or Interlock Devices, our highly skilled attorneys will be able to assist you.

We can also provide you with information and assistance with the following situations you may run into in defending your DUI charges:
