DUI Arrest & Court Process

After you have been arrested and taken into police custody, your case will be sent to the District Attorney's Office for review.  If the prosecutor assigned to your case chooses to proceed forward and file charges, you will be scheduled for an arraignment (basically your first court appearance at the Pittsfield District Court).  If the prosecutor decides not to file charges, your case will likely be dismissed.

At the arraignment the judge will inform you of the charges being filed against you. You then will enter your plea of guilty or not guilty.  After the arraignment a pre-trial conference will be scheduled, and you and your attorney will need to decide whether it is best to proceed forward and go to trial, or if you should accept a plea bargain.
