- The officer had no reasonable suspicion to stop you in the first place. An investigatory stop is unconstitutional if the stop is not supported by reasonable suspicion of any criminal activity. Accordingly, if the police officer lacked a valid reason for making the stop, all evidence of drunk driving obtained as a result of your unlawful stop must be suppressed.
- Your blood/breath alcohol level was rising at the time you were stopped by the officer and even though the test results indicated you were above the legal limit when you were tested, you were actually below the limit at the time you were driving. Our forensic alcohol expert may project and testify what your level was at the time of driving, thus revealing inaccuracies regarding the Commonwealth's test results. - Even though the officer may describe your failed field sobriety tests so that it appears as though you were under the influence of alcohol - or drugs - any impairment you may have exhibited was not caused by alcohol, but rather by other factors.
