With the implementation of Melanie's Law in 2005, penalties are much steeper than they were previously.  So even if you are a first time offender, you could still be fined and serve a prison sentence and your license may be suspended for up to 1 year.  There is a "24D" alternative disposition program that you may qualify for, which could lead to a lighter sentence of probation, enrolling in an alcohol education program, some fines and a shorter license suspension of approximately 45 days.  A repeat offender will not qualify for this.  If you are a repeat offender you can expect much stiffer fines and jail sentences, as well as having your license revoked.

Many drivers do not seem to be aware that driving is not a right but a privilege. It can therefore be taken away by the Commonwealth at any time.  As far as your daily life, the consequences can be severe and unexpected. If your license is suspended and you have no way to get around, you may lose your job.  Your auto insurance rates will certainly increase dramatically.  You will have to come up with the money to pay stiff penalties and other administrative costs.  If you qualify for a Hardship License, you may be able to drive on a limited schedule but you will be required to use an Interlock Device every time you drive.  This will be required for two years or longer.  Obviously this restricts your being able to get around on a regular basis, but can also be quite embarrassing around your family and friends.  Taken altogether, it is obvious that this type of crime is not one to take lightly.  Serious consequences do result, consequences which can affect your life for a very long time.  The conviction will remain on your record and affect your employment and finances for years to come.  It is important to avoid this situation happening to you again in the future at all costs.
