Massachusetts has one of the harshest Boating Under the Influence (BUI) laws in the United States.  If you are under the influence of alcohol or drugs, our State law prohibits you from driving a boat.  The same standard of .08% blood alcohol level is considered to be under the influence in boating as it is when driving a vehicle.  The implied consent law allowing the State to automatically conduct an alcohol test also applies.  Penalties for BUI are severe, with up to 30 months incarceration, fines of up to $1000, or both.  Even your driver's license can be revoked, as well as the registration of your vessel.  Should you cause any type of serious injury while BUI, penalties could include up to 10 years in prison and fines of up to $5000.
