What is a Breath & Chemical Test?
A breath and chemical test is the procedure performed with a breathalyzer device which measures your blood alcohol level. If you are stopped by a law enforcement officer in Springfield and found to be inebriated by a field sobriety test, you will be arrested for drunk driving and taken to the police station for booking. Once at the police station, the police officer will administer a test to determine your blood alcohol content (BAC). Massachusetts laws provide for determining blood alcohol level by means of either a blood or breath analysis. The breathalyzer is the most commonly-used method. The procedure involves breathing through a tube into the breathalyzer machine. The results are recorded as a blood alcohol level and printed out on a ticket. The test is required to be performed twice. This second test result is supposed to be within .02 percent of the first result for the test to be considered valid. If the test result shows.08 percent or greater, then a pretrial suspension of your driver's license for 30 days will occur. If the case is dismissed prior to the pretrial, then the suspension would end at that point.
Either the court or law enforcement may choose to give you a six month suspension on a .08 percent or greater test result for first time offenses. If you are under the age of 21, levels of .02 percent or greater can cause a suspension.
