What Is An Ignition Interlock Device?
If you've had a prior DUI, under the provisions of Melanie's Law you will be required to have an Ignition Interlock Device on your vehicle. An Ignition Interlock Device is a handheld electronic monitoring device that is about the size of a cell phone. It is electronically connected to your vehicle's ignition and can measure blood alcohol levels. You breath into the device before you can start your vehicle. If the interlock device measures over .02% BAC it will prevent your ignition from starting. The system also requires you to take retests periodically while you are driving.
If you have two or more OUI drunk driving convictions and you qualify for a hardship license, you are required to use the device for the duration you have the hardship license. You will also need to use the device for 2 years after your license is reinstated. This 2-year period is added in addition to the time you may have used the device with a hardship license. If you refuse to use the device, you will not qualify for a hardship license and your license will remain suspended.
On a monthly basis you need to take the device in to the installation center to download the data on it. It can occur that these devices do not always measure the alcohol level properly. If they show a false positive, you cannot ignore this result. You must take it upon yourself to go and get a blood test and show that you did not have alcohol in your system, as just two positives in one month will cause you to have your license suspended for up to ten years.
