Although you may not have been drinking, if you have been taking prescription drugs or illegal narcotics, you can still be charged with an OUI, the charge being for the drugs. In Massachusetts, you can be charged with an OUI if you drive while under the influence of any drug, whether it is legal, such as a prescription drug, or illegal, such as marijuana, cocaine, ecstasy, heroin, etc. Even if you are taking an approved prescription drug, if your driving is impaired by that substance, it could still be considered an OUI. You may also be charged with drug possession if you have any illegal drugs on you at the time of your arrest.
Charges for Operating Under the Influence of Drugs are very similar to those for alcohol, as the strategy for defending against those charges. The arrest process and penalties are similar, however, there is no such test as a breathalyzer to measure the amount of drugs in your system. This factor opens up the door to a strong defense against your charges, as the officer's opinion is taken as the only proof of your being under the influence. In addition, you cannot be forced to take a blood or urine test to measure the amount of drugs in your system.

Just as with driving under the influence of alcohol, there are several points the State must prove in order to convict you. Proof will be required that you took the drugs, that they are indeed banned substances such as heroin, marijuana, etc., and that the drugs impaired your driving while driving on a public roadway. Being able to distinguish between the effects of a prescription drug and an illicit drug is almost impossible to prove, so the burden of proof for this type of violation is squarely on the District Attorney's office. The courts of Massachusetts can not automatically prove that you are guilty and have you convicted of the crime. You therefore stand a good chance of beating these charges.
