DUI Defense Special Report

DUI Defense Lawyer in Springfield

Have you been stopped at a Sobriety Checkpoint?

In order to reduce the number of people who may be driving under the influence of drugs or alcohol, Massachusetts law allows for Field Sobriety Checkpoints.  In an ever increasing desire to ensure that drunk drivers are caught and arrested, many checkpoints are commonly being set up by local law enforcement.  These checkpoints are frequently done at night at a busy intersection, particularly where there are restaurants and bars.  The police officer will be at the side of the road and can randomly flag you over to the side of the road.  At that point, they will ask you questions to determine your sobriety.  Having suspicions alone cannot have you arrested, the officer must determine through the usual procedures such as a Field Sobriety Test, whether you may be driving under the influence.

The requirements by law enforcement to follow the guidelines for testing still apply as in any other traffic stop.  Any errors made during the sobriety checkpoint stop will cause any evidence following a stop inadmissible.  There is a good chance we may be able to defend you against these charges, but you need to contact one of our skilled Springfield OUI Defense Lawyers as soon as possible so that we may assist you in your defense.

Finding yourself as a "defendant" and having to be booked and fingerprinted may seem to be a horrible situation with no hope.  You must not forget, however, just because you were charged with an OUI/DUI, it is far from being guilty of the crime.  Police officers do make mistakes and their errors and procedural mistakes are common in Massachusetts.  Your case must be proven beyond a reasonable doubt by the District Attorney's office.  We have obtained successful outcomes for many of our clients.
