OUI Defense Lawyer in Springfield

Drinking and Driving under 21

While drinking and driving can cause strict penalties and consequences, the penalties for OUI if you are under 21 years of age are much more severe.  Massachusetts State law is known to have a zero tolerance policy for drinking and driving for those who are minors, as minors already have inexperience affecting their driving skills.  A mere BAC of .02%, basically as little as one drink for most minors, is considered to be over the legal limit.  The normal percentage for adults is .08%.  Suspensions and penalties will follow an OUI, particularly if you refuse to take a breath test.  This could leave you subject to a 3 year driver's license suspension.

Even though the standards used to judge a minor as being intoxicated are lower, the same defense strategies can still be used to challenge an underage OUI arrest. The Defense Attorney is still required to prove and provide evidence of the charges, including proving he had probable cause for a traffic stop and that you were the driver.  As being involved in this situation is very serious, we highly recommend you obtain the services of a capable and skilled OUI Defense Attorney in Springfield to defend this charge in court.  Although you are young and may not see how this will impact you later in life, it is not recommended to merely accept this charge. A criminal conviction can follow you for the rest of your life.  The effects of any OUI conviction on your record are significant, and more so for minors. Having a criminal record can affect your future ability to obtain certain employment, as an employer may pull your record as part of the hiring process.  Your record may disqualify you for a scholarship and it is certain your insurance will be increased dramatically for quite some time as well.   Being aware of these consequences is important in any decision you make on how to handle your DUI charge.
